Tertiary Decree and Office Design: How to Take Action Before 2030

If you occupy more than 1,000 m² of office space, you’re familiar with the Tertiary Decree. Since 2019, it requires you to reduce your energy consumption by 40% by 2030. The deadline is approaching, and inspections are increasing in 2026.
The good news? Office design can reduce consumption by 20 to 35%, while improving comfort and productivity for your teams. We’ve supported over 200 companies, particularly with compliance. Here’s how to do it.

Tertiary Decree: Where Are We in 2026?

Decree No. 2019-771 of July 23, 2019, which establishes the Tertiary Eco Energy Scheme (DEET), sets ambitious targets: 40% reduction in energy consumption by 2030 (compared to a reference year between 2010 and 2019), then 50% in 2040 and 60% in 2050.

All commercial buildings over 1,000 m² are affected: offices, retail spaces, hotels, educational establishments… Whether you’re in Paris, Île-de-France, Lyon, Bordeaux, Toulouse, Nantes or elsewhere in France, the obligation applies. And be aware: owners AND tenants are jointly responsible.

Things are getting serious now. In 2026, ADEME and prefectures are intensifying inspections. Penalties are becoming real: up to €7,500 fine per undeclared site, €15,000 for repeat offenses. And before September 30, 2026, you must declare your 2025 data on the OPERAT platform.

Why Design Is a Major (and Underestimated) Lever

Many companies think they need major works to comply with the Tertiary Eco Energy Scheme: complete insulation, HVAC system replacement, etc. Yes, sometimes. But office design offers quick, manageable and profitable gains.

Specifically, here’s what a well-designed project can impact:

Heating and air conditioning represent 40 to 50% of your total consumption. Good design can reduce this by 10 to 20% through thermal zoning, surface optimization and better interior insulation.

Lighting accounts for 15 to 20% of the energy bill. Switching to LED with presence detection cuts this consumption in half, or even by three. That’s a 40 to 60% reduction on this item.

IT equipment (computers, screens, printers) accounts for 20 to 25% of consumption. By choosing low-consumption equipment and organizing spaces to share equipment, you save 10 to 15%.

Ventilation represents 10 to 15% of energy consumed. A design that optimizes airflow and reduces volumes to ventilate saves 5 to 10%.

In total, strategic design can reduce your overall consumption by 20 to 35%, depending on the initial state and project scope. And the return on investment? Between 2 and 4 years, taking into account energy savings and productivity gains.

5 Design Solutions to Reduce Your Consumption

1. Surface Optimization (Right-Sizing)

Reducing unused square meters means less surface to heat, light and cool. We systematically analyze actual occupancy rates before designing a project. Result? Companies go from 15 m² per person to 10 m² (through flex office, desk sharing, shared collaborative spaces) and reduce their consumption by 25 to 30%.

It’s one of the most powerful levers. And it simultaneously improves the employee experience.

2. LED Lighting + Presence Detection

Lighting represents up to 20% of consumption. Switching to LED with presence detection cuts this bill by two to three. Specifically: you save 40 to 60% on this item, with a return on investment in 1 to 2 years.

LED and presence detection? Included as standard in all our professional office design projects. Because it’s one of the most profitable investments, and it also improves visual comfort and quality of life at the office.

 

3. Smart Thermal Zoning

Creating thermal zones according to use prevents unnecessary heating or cooling. Open spaces benefit from maximum comfort. Meeting rooms are programmed to reduce temperature when not in use. Circulation and passage areas are maintained at 16-17°C. This zoning, controlled by programmable thermostats, reduces heating and air conditioning consumption by 10 to 15%.

We integrate this logic from the 3D design phase, so that the layout and technical equipment are coordinated from the start.

4. High-Performance and Sustainable Materials

We favor insulating partitions (both acoustic and thermal), low-VOC floor coverings and paints (A+ rated), and eco-designed or refurbished furniture (FSC, PEFC, Cradle to Cradle certifications). These choices reduce consumption by 5 to 8%, while improving indoor air quality and acoustic comfort.

5. Optimized IT and Electrical Equipment

IT and office equipment accounts for 20 to 25% of consumption. We recommend favoring laptops (three times less energy-intensive than desktop towers), low-consumption screens (less than 30W, with automatic shutdown after 10 minutes of inactivity), power strips with switches to avoid hidden standby power, and shared printers (one for 20 people, instead of one per office).

Result: 10 to 15% savings on this item, with an almost immediate return on investment.

 

2026-2030 Deadlines: When to Act?

On September 30, 2026, you must declare your 2025 data on OPERAT. Inspections will intensify. And December 31, 2030, is the critical deadline: the -40% target imposed by Decree No. 2019-771 becomes mandatory.

Four years remain. A design project takes on average 3 to 6 months (design + works). If you launch your project now, you can be compliant by 2026 or 2027, with a comfortable safety margin for 2030.
